TERMS AND CONDITIONS - Important, please read
1. PRICES
1.1 All retail price lists show prices inclusive of VAT at the UK rate of 17.5% (which may be deductible for some overseas destinations) and delivery to mainland UK. Please contact the Cumbria Farmer Network for delivery prices elsewhere (01768 895973 or video@cumbriafarmernetwork.co.uk.) If by mistake we have under-priced an item, we will not be liable to supply the item at the stated price, providing we notify you before we dispatch the item. Postage and packaging rates will change according to the rates applicable at the date you place your order. We reserve the right to alter prices at any time and to invoice at the price ruling on the date of dispatch. Please check current prices before ordering.
2. PAYMENT
2.1 We require payments in £ (pounds) Sterling unless an alternative method of payment has been agreed in advance. Payments to be made: online via ‘Google checkout’ ™ or by post or telephone using cheque, credit card or BACS. All payments will be cleared before goods are dispatched. Goods for overseas delivery to be paid for in advance.
3. AVAILABILITY
3.1 If for any reason beyond our reasonable control we are unable to supply a particular item, we will notify you as soon as possible.
4. ACCEPTANCE
4.1 A contract will not be formed between you and us unless and until we dispatch the goods to you. Up until that point we may decline to supply the goods to you without giving any reason. At the moment the goods are dispatched (and not before), a contract will be made between you and us and you will be charged for the goods. 5. OWNERSHIP OF GOODS
5.1 Title in the goods will remain with The Cumbria Farmer Network, until such time as payment has been received in full of all monies owed to The Cumbria Farmer Network at any time by the buyer.
6. DELIVERY
6.1 We will deliver the goods to the address specified by you by telephone, letter or on the completed order form. We aim to deliver within 30 days of the date of your order but we will not be liable for loss resulting from a delay in delivery arising out of any cause beyond our control.
7. CANCELLATION
7.1 You may cancel your order up to 7 days from placing it by contacting The Cumbria Farmer Network. If the item has not been dispatched we will not take payment from your card. In the event that you cancel your order after the goods have already been dispatched you can refuse to take delivery and return the goods to us and we will refund the price paid. If you have taken delivery you must contact us within 7 days of receipt to organise for the product to be returned and the refund issued.
7.2 If you do not return the goods within 30 days of your cancellation then, after our reasonable attempts to recover the goods, you will be deemed to have accepted the goods, at which point a new purchase contract will be made and you be charged for your order at the price set out on the website.
8. RETURNING GOODS
8.1 If you wish to return goods you have a duty to keep them in your possession and to take reasonable care of them until you return them. We will accept these returns provided you return them:
· within the 7 day cancellation period, for any reason, or
· within 30 days of dispatch of to you if the items are damaged, defective or faulty
8.2 If an item has been returned for any reason other than a product fault or a mistake we have made, you will be refunded the cost of the goods plus postage and packaging charges for the cost of returning the goods. The Cumbria Farmer Network cannot be held responsible for non-delivery of returned goods. This does not affect your statutory rights.
8.3 What you need to do:
Contact The Cumbria Farmer Network office. Place the items into their original box and make sure the parcel is sealed securely and get a certificate of posting from the Post Office.
For refunds: once we have assessed the items, the money will be put back on to the credit/debit card that was used to place the order online.
9. OVERSEAS ENQUIRIES
9.1 It is not possible to include all the necessary information about carriage etc. Please enquire via e-mail, letter, fax or telephone and we will deal with these on an individual basis.
10. CUSTOMS
10.1 Any customs or import duties are levied once the package reaches your country. Additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, you are advised to contact your local customs office for further information.
11. PAYMENT
11.1 We request payment as set out on our website. Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order.
11.2 Our liability to you in connection with any order will not exceed the total price charged for the relevant items.
12.1 Preservation of your privacy is important to us. If you have any request concerning your personal information or any queries with regard to our processing, please contact us at video@cumbriafarmernetwork.co.uk.
12.2 The Cumbria Farmer network collects the details provided by you on registration together with information we learn about you from your use of our service. We also monitor customer traffic patterns & use which enables us to improve the service we provide.
12.3 When you have requested it, we will use your contact details to communicate with you to send you offers and news about other products and services that we provide. We may contact you by post, e-mail, telephone or fax for these purposes. Please note that we may need to contact you in any event, for administrative or operational reasons relating to our service.
12.4 Our website contains links to other website which are outside our control. If you access other sites using these links, the operators of the sites may collect information from you which will be used by them in accordance with their own privacy policy, which may differ from ours.
12.5 Cookies may be used to help us improve the service we provide. Information gathered by cookies will only be used to assist the purposes set out in this privacy policy. Cookies are computer programs designed to collect data from visitors to a website.
12.6 It is not our policy, under normal circumstances, to share any details with third parties.
13. COMPUTER VIRUSES
13.1 All documents which can be downloaded from our site (e.g. price lists and order forms) are scanned for viruses before being put onto the site. We do our best to keep our anti-virus software up-to-date and scan all attachments etc. We cannot accept responsibility for damage arising from computer viruses or similar effects. It is the responsibility of the user to check for and protect against any viruses which may be undetected.
14. GENERAL
14.1 These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.
14.2 If any of these terms and conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining terms and conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
15. DISCLAIMER
15.1 Whilst we endeavour to ensure that the information contained on this site is true and accurate, we cannot give any warranty to that effect. We do not in any circumstances accept responsibility for errors or omissions or for any action or decisions based on the information. We cannot be responsible for the consequences of reliance on that information. Any information of an advisory nature is general only and cannot be regarded as applicable to a specific case.
